Cloud Castles ("CC", "we", "us", or "our") is committed to protecting your privacy. This Privacy Policy ("Policy") describes how we collect, use, disclose, and store your Personal Information. It applies to all Personal Information collected via the websites at cloudcastles.gg and digitalinsightgames.com (collectively, "Websites"), as well as written, electronic, and oral communications with us.

"Services" means the Cloud Castles game client, servers, and related offerings, including gameplay, account creation, matchmaking, chat, anti-cheat systems, and any other features provided through platforms such as Epic Games Store, Steam, PlayStation Network, or others, as well as any future expansions or additions to these offerings and any associated websites.

By using our Websites or Services, including the Cloud Castles game, you accept our privacy practices described in this Policy. If you do not feel comfortable with any part of this Policy, you should not continue to use our Websites or Services.

We may modify this Policy from time to time. The date of change will be shown at the top of this page. We encourage you to read this Policy periodically to ensure you have up-to-date knowledge of our privacy practices. By continuing to access or use the Websites or Services after changes to this Policy become effective, you agree to be bound by the revised Policy. If any changes are unacceptable to you, you may stop using our Websites or Services at any time.

If you are a resident of the European Economic Area ("EEA"), this Policy applies to you in full. EEA residents should also review Section 10 below, which provides additional detail about how we process your Personal Information, the legal bases we rely on, the purposes of processing, who we share it with, international transfers, and your rights regarding your personal information.

We collect Personal Information when you use our Websites or Services or submit Personal Information to us. Personal Information is any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. When you contact us, including by email or through community channels such as Discord, we may collect and store certain information about you and the activity you engaged in, for example your name and contact information, information that you voluntarily provide to us, the nature of your communication, the purpose of the interaction, and the action we took in response to your inquiry or request.

We may automatically collect limited information about your use of our Services, and limited technical information that may be generated when you use our Websites. We refer to this information as "Usage Data." For example, we may collect:

We do not currently use cookies on our Websites. The Cloud Castles game client and services do not use browser cookies. Certain limited technical or log information may nonetheless be generated in connection with operation of our Websites or Services, as described elsewhere in this Policy.

We do not currently use analytics technologies to track users' activity on our Websites, such as pages visited, time spent on pages, referring sites, or similar browsing activity.

We may collect limited technical, gameplay, and performance information in connection with the Cloud Castles game client and services in order to operate, maintain, and improve the game experience.

3. How We Use Your Personal Information

We will only use your Personal Information as described in this Policy or otherwise through your informed consent. We use it for the purposes below, across our Websites and the Cloud Castles game client and services.

a. To Provide Our Services to You

We use your Personal Information to provide information or perform services that you request. We may use limited technical and gameplay-related information to provide access to the Cloud Castles game, support matchmaking, maintain service quality, and troubleshoot service issues. If the applicable information is to be provided or service is to be performed by a third party, then we will disclose the applicable information to the third party providing the information or performing the applicable services. Your information may be available or provided to third-party service providers who are contractually obligated to protect your information as disclosed in this Policy. We have not and do not sell any Personal Information to any third party.

b. For the Operations and Administration of Our Business

We use your Personal Information for the purposes of furthering our business, including creating, operating, delivering, maintaining, and improving our content, products, and services. We may use limited technical, gameplay, and performance information relating to our Services for operational, troubleshooting, and service-improvement purposes. Aggregated forms of this data may also be used for research and development purposes in order to offer new features, functionalities, products, and services.

c. For Business Analytics Purposes

We analyze, and may engage third parties to analyze, your Personal Information and Usage Data to help us understand, maintain, and improve our Services. This may include analyzing limited technical, gameplay, and performance information relating to the Cloud Castles game client and services.

d. For Our Own Marketing Purposes

We do not currently send marketing communications or newsletters. If that changes in the future, we may use contact information you provide to send you promotional or informational communications, and we will update this Policy accordingly.

e. To Provide Customer Support or Respond to You

We collect information that you provide to us when you contact us, including by email or through community channels such as Discord, such as with questions, concerns, feedback, disputes, or issues, so we can address your needs and support your use and enjoyment of the Websites or Services.

f. For Network Security Purposes

We care about keeping you secure and safe while using our Websites or Services. Keeping you safe requires us to process certain technical, gameplay, and other relevant information to proactively manage privacy and security risks. We use such information to combat spam, malware, malicious activities, or security risks, and to improve and enforce our security measures.

g. To Enforce Compliance with Our Terms and Agreements or Policies

When you access or use our Websites or Services, you are bound to our Terms of Service and this Policy. To ensure you comply with them, we may process your Personal Information to investigate, prevent, or mitigate alleged or actual prohibited, illicit, or illegal activities on our Websites or Services. We also process your Personal Information to investigate, prevent, or mitigate violations of our Terms of Service, agreements, or policies.

4. Information Sharing and Disclosure

Your Personal Information is not shared with third parties without your permission, except as described below.

a. Information Shared with Our Employees and Services Providers

We may engage employees and third-party service providers to work with us to administer and provide the Websites or Services, including infrastructure, hosting, development, and customer support. These employees and third-party service providers have access to your Personal Information only for the purpose of performing services on our behalf and are expressly obligated not to disclose or use your Personal Information for any other purpose.

b. Information Disclosed in Connection with Business Transactions

If we are acquired by a third party as a result of a transaction such as a merger, acquisition, or asset sale, or if our assets are acquired by a third party in the event we go out of business or enter bankruptcy, some or all of our assets, including your Personal Information, may be disclosed or transferred to a third-party acquirer in connection with the transaction. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to this Policy. Any information you submit or that is collected after a transfer, however, will be subject to a new privacy policy adopted by the successor entity.

We cooperate with government and law enforcement officials to enforce and comply with the law. We may disclose information about you to government or law enforcement where we reasonably believe it is necessary or appropriate: to enforce our Terms of Service, to respond to claims and legal process, to protect the property, rights, and safety of a third party, our users, or the public in general, to protect our property, rights, and safety, to stop any activity that we consider fraudulent, illegal, unethical, or legally actionable, including cheating or toxic behavior in the Cloud Castles game, and as required by applicable local, state, or federal laws.

5. Data Security

We safeguard the security of the information you provide to us with physical, electronic, and administrative procedures. While we strive to protect your information, we cannot guarantee the security of the Internet, and cannot ensure the security of the information that is transmitted through the Internet. Please recognize that protecting your Personal Information is also your responsibility. We urge you to take every precaution to protect your information when you are on the Internet, or when you communicate with us and with others through the Internet. We recommend that you do not post on or through our Websites or Services any information that you do not want to make available to other users or the public generally. You assume all responsibility for any loss of privacy or other harm resulting from information you post publicly.

6. Responding to Do Not Track Signals

We do not currently respond to web browser "Do Not Track" signals. We also do not currently respond to Global Privacy Control, or GPC, or similar opt-out preference signals because we do not currently sell or share personal information or use personal information for targeted advertising. If that changes in the future, we will update this Policy accordingly.

7. Children and Privacy

Protecting children's privacy is important to us. Our Websites and Services are intended for users who are at least 16 years old, as further described in our Terms of Service. We do not knowingly collect personal information from children under the age of 13. If we learn that a child under the age of 13 has provided Personal Information through the Websites or Services, we will use reasonable efforts to remove such information from our files and servers.

8. Links to Third Party Sites

Our Websites or Services may contain links to sites or services that are owned or operated by third parties, such as Discord and social media platforms. We are not responsible for the content, privacy, or security practices of any third parties. To protect your information, we encourage you to review the privacy policies of those third parties.

9. Your Choices

a. Information You Have Provided

If you would like to access, correct, or delete Personal Information you have provided to us, you may contact us at privacy@digitalinsightgames.com.

Please note that we may retain certain information when required or permitted by law. You may also exercise certain rights regarding your Personal Information as described in Section 11.

b. Promotional Communications

We do not currently send promotional emails or newsletters. If that changes in the future, you will be able to opt out by following the instructions in those communications. We may still send non-promotional communications, such as responses to support or privacy inquiries, or notices about updates to our Terms of Service or this Policy.

10. International Transfer and EEA/UK Rights

Your information may be stored and processed in the United States or other countries where we or our service providers operate. If you are located outside the United States and use our Websites or Services, or otherwise provide Personal Information to us, please note that your information may be transferred to and processed in countries that may not provide the same level of data protection as your jurisdiction. We will update this Policy from time to time to reflect material changes in our data practices.

When we process your Personal Information, we will only do so in the following situations:

Examples may include processing limited technical, gameplay, and performance information to operate, maintain, secure, and improve the Cloud Castles game and related services.

We retain Personal Information for no longer than is necessary for the purposes for which it is processed, unless a longer retention period is required or permitted by law. The length of time we retain information depends on the nature of the information and the purpose for which it was collected, including to provide our Services, respond to support or privacy inquiries, maintain service operations, resolve disputes, enforce our agreements, and comply with legal obligations. When Personal Information is no longer needed, we will delete it or anonymize it where appropriate.

c. Data Subject Requests

Subject to applicable law, you may have the right to request access to the Personal Information we hold about you, to request that your Personal Information be corrected, erased, or made available in a portable form, and to object to or request restriction of certain processing. Where we rely on your consent, you may withdraw that consent at any time.

12. Privacy Rights for Other U.S. States

In addition to the rights described in Section 11 for California residents, residents of other U.S. states with comprehensive privacy laws, including Indiana, Kentucky, Rhode Island, Colorado, Connecticut, Virginia, and others, may have similar rights where the law applies to our processing, including:

Verification may require confirming your identity via email or other secure means. We will not discriminate against you for exercising these rights.

Opt-Out Preference Signals. We do not currently sell or share Personal Information or use Personal Information for targeted advertising. Accordingly, we do not currently offer opt-out mechanisms specific to those activities. If that changes in the future, we will update this Policy and respond to opt-out preference signals as required by applicable law.
